A student who, by a preponderance of the evidence, under these Rules and
Regulations, is found to have illegally possessed, used sold or distributed any
drug, narcotic, or controlled substance, whether the infraction is found to have
occurred on or off campus, shall be suspended for a period of not less than the
remainder of the semester in which the infraction occurred plus the following
long semester. In the event the semester in which the infraction occurred has
ended by the time a student is found guilty, the student shall be suspended for
a period of not less than the following two long semesters. With the approval of
the president or the president’s designee, suspension may be probated and
sanctions may then include required counseling and/or rehabilitation along with
other appropriate penalties.
The president of each System component shall submit a written report
quarterly to the chairman of the local committee, which details all cases in
which a suspension has been probated. A second infraction for a drug related
offense shall result in permanent expulsion from the component and from all
other institutions in the Texas State University System.
University policy prohibits the unlawful manufacture, distribution,
dispensation, possession or use of controlled substances in University
workplaces. University employees who violate this prohibition are subject to
disciplinary action, including termination.
Fourteen residence halls are
designated as alcohol-free. In these halls, students must sign agreements
to abide by the policy and alcohol is not permitted regardless of students'
age. In all other residence halls, the University permits students who are at least 21
years of age to have alcoholic beverages in their residence hall rooms, but not in common
areas of halls or other public places on campus unless allowed by the Dean of Students.
Illegal acts commonly associated with alcohol include public intoxication, driving while
intoxicated, providing alcohol to a minor, bringing keg beer into the residence halls and
minor in possession of alcohol. Violation of these laws subjects students to disciplinary
actions. Guidelines have been established for
sanctions imposed on students who violate Texas State University's alcohol policy.
The University reserves the right to disclose to a
parent or legal guardian of a student, information regarding any violation of any Federal,
State, or local law, or of any rule or policy of the institution, governing the use or
possession of alcohol or a controlled substance, regardless of whether that information is
contained in the student's records, if the student is under the age of 21 and the
institution determines that the student has committed a disciplinary violation with
respect to such use or possession.
In addition to disciplinary sanctions imposed by
the University for violation of alcohol and drug laws, students and employees may also be
prosecuted under State and Federal laws.

Texas State University provides services and programs designed to
reduce the incidence of crime on campus and to support the victims of crime. The Alcohol
and Drug Resource Center is a nationally recognized program that provides counseling and
referral services for alcohol and drug-related issues. The Center staff and The Network, a
group of trained paraprofessionals within the Center, conduct educational programs for Texas State University
students on the risks of alcohol and drug abuse, especially binge drinking, sexual assault
prevention and other health and safety topics. In addition, Alcohol and Drug Resource
Center staff provide a two-hour Alcohol Education Seminar for first-time student violators
of University policies who are referred to the Center.

The Counseling Center at Texas State University provides counseling to
students who are victims of crimes and/or have personal issues related to theirs or
others' alcohol abuse and drug use. The staff can also provide referrals to community
services for students and university employees. Each issue of the Texas State University Personnel Bulletin
highlights the Employee Helpline telephone numbers where faculty and staff can call the
Counseling and Alcohol and Drug Resource Centers for referral assistance.
